Chandler v. Discount Power, Inc., No. HHD-CV-14-6055537-S (Conn. Super. Ct.)

Plaintiff brought this suit on behalf of all customers of Discount Power in Connecticut alleging that Discount Power charged extraordinarily high variable rates for the supply of electricity that were not – contrary to the provisions of Discount Power’s contract — linked to the market rate for electricity.  The Complaint was filed in November of 2014 in the Superior Court for the Judicial District of Hartford.

On November 21, 2016, the Court granted preliminary approval to a Class Action Settlement that would require Discount Power to pay $850,000 to the Settlement Class.  The Court has scheduled a hearing to determine whether to give final approval to the settlement, as well as to approve plaintiffs’ motions with respect to an award of attorneys’ fees and expenses as well as case contribution awards.

In connection with the proposed settlement, the Court provisionally certified a class consisting of Discount Power customers in Connecticut who were charged variable rates for their electricity from June 1, 2013 to July 31, 2016.  If you are a member of this class, you should review the Class Notice attached below for a detailed description of your rights under the proposed settlement.  Further details can also be found at the dedicated website for the settlement, www.discountpowersettlement.com, where you can also file an online claim to recover under the settlement.  The deadline for Class Members to file claims is March 10, 2017, and the deadline to either object to, or opt out of, the settlement was February 27, 2017.

On March 27, 2017, the Court granted final approval to the Settlement, as well as approving Plaintiff’s Motion for an Award of Attorneys’ Fees, Reimbursement of Expenses, and Case Contribution awards.  Copies of the Orders are attached below.  Pursuant to the terms of the Settlement Agreement, distribution of the proceeds of the Settlement will occur after Defendant makes its last payment to the escrow account, which must occur by no later than December 31, 2018.  If you have filed a claim in the case and your address changes, please send information concerning your change of address to the Settlement Administrator at  info@DiscountPowerSettlement.com or by telephone, 1-877-435-2043.  Make sure to include the name of the case, your full name, your prior address and your change of address in your communication.
