Edwards v. North American Power

Plaintiff brought this suit on behalf of all customers of North American Power (“NAP”) in Connecticut, Rhode Island, New Hampshire and Maine, alleging that NAP charged extraordinarily high variable rates for the supply of electricity that were not – contrary to the provisions of NAP’s contract — linked to the market rate for electricity.  The Complaint was filed in November of 2014 in the U.S. District Court for the District of Connecticut.  On August 4, 2015 the Court largely denied Defendant’s Motion to Dismiss the Complaint with respect to residents of Connecticut, but granted the motion with respect to class members from other states.  Plaintiff has filed a motion for leave to file an amended complaint, which remains pending.

On January 16, 2018, the parties reached an agreement on a Settlement to the litigation, which the Court preliminarily approved on March 30, 2018.  After notice to the Class and a public hearing, the Court gave final approval to the Settlement on August 3, 2018.  Barring an appeal from the Judge’s order, the Settlement will become final in September.  Once the Settlement is final, the Claims Administrator will send checks to class members who timely filed a claim form as soon as all claim forms have been checked and verified and the allocation calculations are completed.  Please be patient.
