07 Jan Nistra v. Reliance Trust Company
This class action was filed in the United States District Court for the Northern District of Illinois on April 29, 2016, on behalf of a class of participants in the Bradford Hammacher Group, Inc. Employee Stock Ownership Plan (the “Plan”). The plaintiff alleged that Reliance Trust, as trustee of the Plan, breached its fiduciary duties to the Plan and its participants by allowing the Plan to purchase shares of The Bradford Hammacher Group, Inc. at an inflated price.
The Court denied Defendants’ Motion to Dismiss the Complaint on July 12, 2016 and the case proceeded to discovery. The Court certified the class on February 13, 2018, and the case proceeded to trial on April 23, 2019. On May 20, 2019, the parties informed the Court that they had reached an agreement to settle the case.
On March 12, 2020, the Court preliminarily approved the settlement and authorized notice to be sent to class members.
The settlement was approved on June 19, 2020.
