Wood v. Prudential Retirement Insurance & Annuity Company

Plaintiffs brought this class action on behalf of the KeHe Distributors, Inc. 401(k) Retirement Savings Non-Union Plan, the EXCO Resources, Inc., 401(k) Plan, and all similarly-situated employee pension benefit plans covered by the Federal Employee Retirement Income Security Act (ERISA).  Plaintiffs allege that Prudential Retirement Insurance & Annuity Company (“PRIAC”) improperly keeps for its own benefit amounts earned on retirement plan assets invested in certain of its stable value funds above a certain percentage which Defendant has discretion to set.  The Complaint was filed in the U.S. District Court for the District of Connecticut in December of 2015.

The case was voluntarily dismissed on October 12, 2017, following the District Court’s ruling denying class certification.
