Newmont Mining Corp.

This case covers all purchasers of the securities of Newmont Mining Corp. (“Newmont”) during the period from July 28, 2004 through April 26, 2005.

Schatz Nobel Izard, P.C. was appointed as Co-Lead Counsel by the United States District Court for the District of Colorado on March 22, 2005. An Amended Complaint, filed on April 28, 2006, alleges that Defendants misrepresented Newmont’s financial results and condition by concealing increasing production costs and overstating the amount of copper and gold the company could extract in 2005.

The parties agreed to a settlement in the amount of $15 million, which was approved by the Court on December 11, 2007. On September 30, 2008, the Court granted final approval of the settlement. In May of 2009, settlement funds were distributed to Class Members.
