24 May Hamrick et al v. E.I. du Pont de Nemours and Company et al
Plaintiffs are participants in Title I of the DuPont Pension and Retirement Plan receiving the Plan’s Income-Leveling Option (“ILO”), a benefit form that increases benefits until age 62 and then reduces participants’ benefit amounts thereafter. Plaintiffs brought this class action against DuPont and the Administrative Committee of DuPont’s Pension Plan alleging that the Defendants improperly reduced the benefits they receive under the Plan’s ILO in violation of the Employee Retirement Income Security Act. Defendants have not yet responded to Plaintiffs’ Complaint.
