Manning et al v. E.I. du Pont de Nemours and Company et al

Plaintiffs are participants in Title I of the DuPont Pension and Retirement Plan receiving a Spousal Benefit Option form of benefit (“SBO”) under which the participant’s spouse receives monthly benefits after the participant’s death. Plaintiffs brought this class action against DuPont and the Administrative Committee of DuPont’s Pension Plan alleging that the Defendants improperly reduced the benefits they receive under the Plan’s SBO in violation of the Employee Retirement Income Security Act. Defendants have not yet responded to Plaintiffs’ Complaint.
